An Asian trader has filed a case before an Eldoret court, accusing his son-in-law together with his two brothers and father of assault and eloping with his daughter-in-law.
The 60-year-old trader – Ibrahim Sadik – in court documents – also claims the accused subjected him to bodily harm during the incident.
When he appeared before Eldoret Principal Magistrate Mogire Onkoba, Wednesday, Sadik narrated how his in-laws subjected him to thorough beatings at his homestead in Elgon -View estate on the outskirts of Eldoret town.
“I became unconscious due to thorough beating when my in-laws descended on me with kicks and blows from every direction. Despite my old age, they battered me mercilessly,” the trader told the court.
He further said he has video footage of CCTV cameras that captured the attack which he said he will be presenting in court as part of evidence in the case.
The trader’s son-in-law Khalid Umar, his two brothers Asif Salim and Tawqir Munir and their father Umar Mohammed have jointly been charged with assault, a crime they are alleged to have committed within Elgon View estate in Eldoret town on April 23, 2022.
They are also facing another charge of causing actual bodily harm contrary to section 251 of the Penal Code.
Taboo
Further, they are an alternative charge of malicious damage to property belonging to the complainant.
In his testimony, the complainant regretted that it was taboo for a son-in-law to be in direct body conduct with his father and mother-in-law as was the case during the said incident.
He also alleged that the incident has subjected him to ‘immense mental harassment’.
The son-in-law has already initiated a legal process of divorce after his in-laws allegedly forcefully ejected their daughter from her marriage as well as assaulted his father.
However, the accused denied the charges terming the allegation by their former father-in-law as a diversionary tactic to the ongoing divorce process.
Each of the four accused was released on Ksh10,000 cash bail.
The son-in-law in question is expected to testify in the case on June 6 when the hearing will continue.
