Opinion: Uhuru’s Remarks on BBI during Jamhuri Day a Show of Arrogance

I was comfortably watching President Uhuru Kenyatta’s speech during the Jamhuri Day celebrations – his last national event he will be leading as the head of state.

What shocked me during the speech was the fact that Uhuru insisted that he was hoping to change the constitution through the Building Bridges Initiative (BBI) and that he still believes it will be back someday.

The courts have twice, first through the High Court and second through the Court of Appeal pronounced itself on the matter, ruling that the whole BBI process was null and void.

It is not right for the President as a leader, to go on insisting about BBI changes yet the courts have made it clear that it is illegal for him to initiate a constitutional change.

We all agree that the BBI bill was unconstitutional, at least according to the courts and it is shocking to see the President insisting on changing the Constitution for – what looks clearly like advancing personal benefits in disguise of benefiting Kenyans.

BBI was declared null and void for not meeting the required standards, it was not taken through public participation which clearly means it did not involve all people.

The President has no powers to change or to initiate Constitutional change, that is a role for people and their representatives – Members of Parliament.

His remarks sound rude as he seems not to care and admit the fact that the courts invalidated the whole process.

It is time Uhuru moved on from the BBI dream and accept the fact that it is dead and buried, if he has to revive it, it should be through the right channel and process – which is clearly spelled out in our constitution.
