Doctor, Ordinance Factory Employee among Four Charged With Assaulting Mathematics Professor over ‘Noisy Prayer’

Four people were on Tuesday presented before an Eldoret Court and charged with attacking and assaulting a Mathematics Professor.

The four, among them a Medical Doctor and an employee of the Kenya Ordinance Factory, are accused of attacking the Mathematics Professor on allegations of holding a noisy prayer during a night vigil.

Court documents indicate that the attack happened as Professor Wilfred Sawanda was holding a night vigil aimed at cleansing his newly acquired plot on the outskirts of Eldoret town.

The court was told that the accused attacked Prof Sawanda, who is also a Pastor for the nuisance caused by the night vigil.

But when they were presented in court, the four, Dr Geoffrey Masika Wechuli an employee of Kapsabet County Referral Hospital, James Nyamweya Mwamba an employee of Kenya Ordinance Factory, Maurice Obiero and Ednah Saeyi Khaemba – all denied charges against them.

They are facing charges of assault that caused actual bodily harm contrary to section 251 of The Penal Code.

Not us

According to the prosecution, the crime was committed on the night of November 9, 2014 at Racecourse estate in Kapseret Sub County.

During defense hearing for the case, Dr Masika admitted that the Mathematics Professor was assaulted by his neighbours.

He however denied being among those that attacked him.

As neighbors, we were concerned with the strange noise that was coming from the professor’s compound and we went to find out what was going on. That is when some of our angry neighbors assaulted,” the Kapsabet County Referral Hospital medic told the court.

Another accused, Dr Khaemba also admitted before the court that Prof Sawanda was attacked by neighbours over the noisy prayer.

She however said she was not among the attackers.

I was not among people who assaulted the complainant bearing in mind that I have taken an oath of protecting life,” Dr Khaemba said.

A medical report from the Moi Teaching and Referral Hospital presented before the court indicate that the Mathematics Professor sustained injuries during the said attack.

Nyamweya, also the accused person told the court that he was awakened by noises that were coming from the rituals the Professor was doing during the night vigil.

He however denied being among the neighbors who attacked him.

Principal Magistrate Mogire Onkoba who is handling the matter adjourned the defense hearing to January 24, 2024.
