The Supreme Court is from noon expected to issue a ruling in regards to a petition challenging the August 9 presidential results petition.
Azimio coalition presidential candidate Raila Odinga, his running mate Martha Karua and five other petitioners moved to the apex court to challenge the results.
And after days of hearing where parties of all sides issued their submissions before the court, the seven judges retreated to make a ruling over the weekend.
Constitutionally, the ruling had to be made before the end of Monday, September 5, 2022.

Already, the court has set noon as the time the ruling will be delivered.
Issues for determination
Here is a list of nine issues the judges will be determining that will ultimately decide whether Dr William Ruto’s win will be upheld or nullified;
- Did the technology deployed by IEBC for the conduct of the 2022 General Election meet the standards of integrity, verification, security and transparency to guarantee accurate and verifiable results?
- Was there interference with the uploading and transmitting of Forms 34A from polling stations to the IEBC public portal?
- Was there a difference between Forms 34A uploaded on the IEBC Public Portal, Forms 34A received at the National Tallying Centre and Forms 34A issued to the Agents at Polling Stations?
- Did the postponement of gubernatorial, parliamentary and ward elections result in voter suppression to the detriment of the petitioners?
- Were there unexplained discrepancies between the votes cast for presidential candidates and other elective positions?
- Did IEBC carry out verification, tallying, and declaration of results per Article 138 of the Constitution of Kenya?
- Were there irregularities and illegalities of such magnitude to affect the final results of the Presidential Election?
- What relief and orders can the court grant/issue?
