Muslim Member Issues Ultimatum to Registrar of Societies over Registration of Eldoret Mosque Committee Association

A member of the Muslim community in Eldoret has issued a 7–day ultimatum to the Registrar of Societies to issue a clarification over the status of the registration of a local Mosque Committee Association.

The member – Jamal Diriwo Omari, claims the current office holders of the Muslim Association Mosque Committee, Eldoret, are imposters.

In a letter to the Registrar of Societies, seen by Uasin Gishu News, Omari argues that the said imposters have irregularly registered a different association, purporting to be the original one, registered in 1957.

“The societies name – Muslim Association Mosque Committee, Eldoret – has been fraudulently forged and registered by strangers as – Muslim Association Mosque Committee – omitting the word ELDORET intentionally aiming to rob the properties under the original organization,” Omari says in part of the letter.

He goes further to note that according to the Attorney General, in a letter dated January 20, 2017, the association’s name was still intact as originally registered.

Registration of a different organization

It is on this basis that Omari wrote to the Registrar of Societies, asking that it takes action over the possible fraud in the registration of a different organization.

“We refer this fraudulent act for your immediate intervention in accordance to the laws of the constitution of Kenya for the purpose of securing and safeguarding the properties and records of the Muslim Association Mosque Committee, Eldoret which was duly and legally registered on the 8^th day of July 1957 as is evidence in the records in the register of the registrar of societies which is not in doubt,” the Eldoret Muslim member says.

According to records that Uasin Gishu News is in possession of, Omari wrote the letter in July 2023. But to date, there has ben no response from the Registrar of Societies, despite following it up with a reminder on October 25, 2023.

On Thursday, he sent out a second reminder, issuing a 7-day ultimatum for the response, failure to which he threatens to take legal action.

Access to Information Act allows any Kenyan to request for information – which the law provides that the relevant public or private institution should provide within 21 days.

“By means of this letter which serves as our final reminder letter, we issue your good office with a 7 days ultimatum to facilitate us with with full information from your offices according to the constitution of Kenya as a law abiding citizens and state agencies,” Omari says in the letter dated December 14, 2023.

“Further, remember failure to abide by the rules of the laws of the constitution, this will act against both parties before the Kenyan court of laws,” he adds.

The Muslim Association Mosque Committee, Eldoret manages assets of the Muslim community within the Eldoret Municipality which are believed to be valued and billions of shillings.
